Apple Inc. (NASDAQ:AAPL) Continues To Fight With Samsung Over Galaxy
Apple Inc. has received authorities if renewing its bid for the ban on the sales of the Galaxy Tab 10.1 tablet computer by Samsung Electronics Co. in the U.S. market.
This renewal for the ban of the sales of its rival’s device came after the U.S. Court of Appeals for the Federal Circuit over-ruled a petition by Samsung which requested for the reconsideration of the court’s verdict on Apple pursuing the ban while a patent- infringement case remains pending. The news of the denial was posted on the official website of the court.
Cupertino, which is a Californian based Apple Company, had charged Samsung Electronic of copying the appearance and the features of its hot-selling products – iPad and iPhone. The company has another case pending against Samsung in California in which is trying to stop the sales of Samsung’s newest Galaxy smartphone. Apple’s request to reconsider the case was earlier rejected by Lucy Koh, the U.S. District Judge in San Jose, California. Koh refused to reconsider as the case was still before the Federal Circuit. However, after the Federal Circuit’s denial today, the appeals court will issue an order that formally sends the case back to Koh.
The global battle for the position in the market in smartphones and tablet computers involve as many as 30 patent suits pending in 10 countries across four continents. The case is Apple Inc. v. Samsung Electronics Co., 12-1105, U.S. Court of Appeals for the Federal Circuit (Washington). The lower court case is Apple Inc. v. Samsung Electronics Co., 11-1846, U.S. District Court for the District of California (San Jose).
Shares of AAPL were trading lower by 0.61% to $583.74.
